Terms of use

These terms apply to your use of subhdesk.in and to any enquiry you send us. If you hire us for a project, the written agreement or quote we both accept for that project also applies. Where the two differ, that written agreement wins.

Who we are

Subhdesk is a brand of PRAVISA PHARMA, based in Navi Mumbai, Maharashtra, India ("Subhdesk", "we", "us"). Contact: reachout@subhdesk.in.

What we do

We provide done-for-you services for small businesses:

• Website / Brochure: a single-page brochure site or a multi-page website
• WhatsApp AI Assistant: an automated assistant on your WhatsApp Business number that answers common customer questions and collects enquiries
• Care Plan: ongoing upkeep of a website, with one improvement a month
• Automation Audit: a paid scoping session for anything custom

Prices

• The final price, scope and timeline for any work are agreed with you in writing before any work starts. Nothing is chargeable until you have accepted a written quote. Applicable GST is included in the written quote.
• If you go ahead with a build after an Automation Audit, the audit fee is credited toward that build as set out in your written quote.
• Monthly plans (for example the WhatsApp AI Assistant monthly fee and the Care Plan) are billed as set out in your written quote.
• Third-party costs (for example domain names, hosting beyond what's included, WhatsApp Business messaging charges, or paid tools) are extra unless your quote says otherwise.

Automated replies and estimates are not quotes

When you send the contact form, an automated assistant may show you a short reply. It may mention which offer looks like a fit. That reply is not a quote and is not binding. Only a written quote from us that you accept is binding. The assistant can make mistakes. If anything it says differs from these terms or from our written quote, the written quote wins.

No guarantee of results

We will do the work we agree with reasonable skill and care. We cannot guarantee business results: more customers, sales, enquiries, search rankings or revenue. Those depend on many things outside our control. We also don't guarantee that third-party platforms (for example WhatsApp, Google or hosting providers) will always be available or won't change their rules.

Your content

• You are responsible for the text, photos, logos, prices, product details and other material you give us to use ("your content").
• You confirm that you own your content, or have all the rights and permissions needed for us to use it for your project, and that it doesn't break any law or anyone else's rights.
• You are responsible for making sure the information on your website or assistant (for example prices, offers and claims about your business) is accurate and lawful.

Using this website

You agree not to:

• send spam, advertising or sales pitches through the contact form, or send it automatically or in bulk
• try to break, overload or get around the site's security, spam checks or rate limits
• try to make the automated assistant reveal its instructions or behave in ways it isn't meant to
• submit someone else's personal details without their permission, or anything unlawful, abusive or harmful

We may block or ignore submissions that break these rules.

Intellectual property

The design, text and code of subhdesk.in belong to PRAVISA PHARMA or its licensors. You may view and share pages for normal purposes but not copy the site to offer competing services. Ownership of the work we create for you is covered by your project agreement.

Limitation of liability

To the extent permitted by Indian law:

• We are not liable for indirect or consequential losses, such as loss of profit, business, revenue or data.
• Our total liability to you for any claim about a service is limited to the fees you paid us for that service in the 12 months before the claim.
• Nothing in these terms limits liability that cannot be limited under Indian law, for example for fraud.

The website itself is provided "as is". We try to keep it accurate and available, but we don't promise it will always be error-free or online.

Privacy

How we handle personal data is explained in our Privacy policy. Unqualified enquiries are kept for 90 days after last contact; see that policy for the full schedule.

Governing law and disputes

These terms are governed by the laws of India. If a dispute comes up, we'll first try to resolve it by talking to you. If that doesn't work, the courts at Navi Mumbai / Thane, Maharashtra have exclusive jurisdiction.

Changes

We may update these terms from time to time. The effective date at the top shows the latest version. For an ongoing project, the terms in force when you accepted your quote continue to apply unless we both agree otherwise.
